1. Acceptance
By creating an account or using PulseIQ, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.
PulseIQ is operated by Richard Robinson, operating Pulse IQ as an individual operating the product. These Terms do not assert a separate registered business entity form.
2. Eligibility
You must be at least 18 years old to create an account or use PulseIQ. By using the service, you represent that you meet this requirement.
3. Accounts and workspace authorization
You are responsible for safeguarding your credentials and for activity under your account. If you invite others into an organization or workspace, you are responsible for ensuring they are authorized to access the content you share.
4. Acceptable use
You agree not to:
- Abuse, disrupt, or attempt to bypass security or rate limits
- Use PulseIQ to violate applicable law or third-party platform rules
- Attempt to circumvent YouTube, Google, TikTok, or other platform limitations
- Upload or generate content you do not have rights to use
5. Your content
You retain ownership of content you submit. You grant PulseIQ the permissions needed to host, process, transform, and display that content to provide the product features you request (including AI-assisted generation and media assembly).
AI-generated outputs can be inaccurate or unsuitable. You are responsible for reviewing and accepting content before publishing or relying on it.
6. Third-party platforms
Connecting Google/YouTube or other platforms is optional and occurs only through their OAuth consent flows. You must comply with those platforms' terms and policies. PulseIQ is not affiliated with, endorsed by, or sponsored by Google, YouTube, or TikTok.
Publishing actions require explicit confirmation in PulseIQ. Automatic publishing without confirmation is not enabled.
7. Intellectual property and copyright
You represent that you have the rights needed for content you upload or ask PulseIQ to process, and that your use will not infringe others' rights.
8. Availability and changes
Features may change, degrade, or be unavailable. We do not guarantee uptime or uninterrupted service.
9. Suspension and disconnection
We may suspend access for security, abuse, or operational reasons. You may disconnect connected platforms and request account or content deletion as described in Data Controls.
10. Disclaimers
To the fullest extent permitted by applicable law, PulseIQ is provided "as is" and "as available." We disclaim warranties not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, where such disclaimers are allowed. Some jurisdictions do not allow certain disclaimers; in those places, the disclaimer applies only to the extent permitted.
11. Limitation of liability
To the fullest extent permitted by applicable law, Richard Robinson, operating Pulse IQ and PulseIQ are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the service. These Terms do not set a specific dollar liability cap, do not require arbitration, and do not waive class-action rights. Some jurisdictions do not permit every limitation; where a limitation is not allowed, it does not apply to you.
12. Governing law
These Terms are governed by the laws of the State of Maryland and applicable United States federal law (Maryland, United States), without automatically adding arbitration, venue, or class-action-waiver language beyond what is stated here.
13. Changes and contact
We may update these Terms by publishing a revised page and updating the last-updated date. Continued use after material changes may constitute acceptance where permitted by law.
